Here's something I keep forgetting to tell you.
Over a year ago Nescafe pressed their grubby noses against my window and asked me if they could use wake up boo to advertise their speed granules in the philippines. They said that they wouldn't use our version but get another band to do a cover. I told them to fuck off of course and that was that.
A few months later a lovely man named Erick contacted me to say that an avert for nescafe in the philippines was using a tune that sounded like one of ours. I rang my publishing company, they rang the company who denied everything and said that it was an original composition. This went on for months until I was finally told that a musicologist said that the song didn't really sound like mine and I should shut up and go away.
Anyway, It's one of the things that has put me off doing this anymore. I must be going deaf. Here it is...enjoy!

here's their website - let's all start posting angry messages in their guestbook when it comes back online.
http://www.bamboo.com.ph
and here's the wikipedia entry for the band... if someone here is registered on wikipedia i think it might be fun to edit it a little bit... _________________

Chuff's sake! Was the musicologist deaf or just bloody stupid?
I'd have said yes, then "accidentally" given them a copy of Corporation Man. _________________ "It's too beautiful to stay inside..." |

That really is blatant, I am (obviously) not a lawyer, but I would be very suprised if you didn't win a case if you tried it. Surely there's some company who would be able to take it on and do all the work so you don't have to waste your time on it.
I mean, the over half of the lyrics are the same and the melody is very very slightly different, chorus especially... how could you loose? apart from that Nestle have probably been careful to make it exactly as different as required by law or something...

Sounds like the singer from Jellyfish!
Complete Bobbins if you ask me. Nestle have never shyed away from dodgy practices though have they? _________________ We would like to announce that due to cutbacks the light at the end of the tunnel has been switched off..... |

It's a ripoff alright, but i'd say it probably is sufficiently different for them to have their asses covered. It must hurt to have your work butchered like that. _________________ www.myspace.com/storkboychoons

I notice they didn't attempt to rip-off the "... you have to put the death in everything" bit...
... which given what I hear about Nestle's approach to marketing powerded milk in Africa, would have been more appropriate. _________________ Scattershot Writing: www.jameseverington.blogspot.com |

They could've at least changed the "Wake up, its a beautiful morning" line, lazy bastards. It's like when Pulp wouldn't let Coke use Sunrise, he's what Jarvis Cocker said:
"Coca-Cola wanted to use Sunrise for this TV ad and I guess they expected us to say yes. But I thought, 'It's about some kind of new dawn. Do I want to hear that song and think about Coke?' So I said they couldn't use it. And they got a load of musicians to write a new song which is uncannily similar. But I'm glad we didn't let them have it. It would have been against my beliefs." |

ok, any nescafe in my house now goes down the lav!
I remember reading an interview with Gruff Rys where he said he'd been put on hold by some business or other and had to listen to himself singing Juxtapozed With U - used without his permission. must be so frustrating.
boycott nescafe I say! _________________ (and gillworm! she's so funny!) |

I give up.
Another bunch of people who asked if they could use it and then decided it would be cheaper for them to steal it.
I've got a hangover, somebody buy me a drink?

What's your poison?
That Today Show song is even worse/blatant than the the Nestle one... At least Nestle our easily 'boycottable', whereas I suspect I'd have to move continents just to deliberatly not watch that show! _________________ Scattershot Writing: www.jameseverington.blogspot.com |
